Welcome to Blue Cove (“we”, “our”, “us”). Blue Cove operates as an influencer marketing and talent management agency.
By accessing or using this website (“Site”) and any services offered through it, you (“User”) agree to comply with and be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use the Site.
These Terms govern your use of the Site and any related content, features, tools, and services, including interactions with creators, brands, campaigns, and communication tools offered by Blue Cove.
Certain services may also be governed by separate written agreements (including talent management agreements, campaign agreements, or brand service agreements). In the event of a conflict, those agreements shall prevail.
NATURE OF SERVICES
Blue Cove acts as a facilitator and manager of influencer marketing and brand collaborations. We do not act as an employer, legal representative, or party with authority to bind users unless expressly agreed in writing.
Creators, talents, and brands engaging through Blue Cove do so as independent parties, each responsible for their own legal, tax, and regulatory obligations.
USE OF THE SITE
By using this Site, you confirm that:
You are at least 18 years old or have legal consent from a parent or guardian
You will use the Site only for lawful purposes
You will not engage in activity that may harm, disable, disrupt, or interfere with the Site, its infrastructure, or other users
We reserve the right to refuse service, restrict access, or terminate accounts at our discretion.
ACCOUNT REGISTRATION
To access certain features, you may need to create an account. You agree to:
Provide accurate and current information
Keep your login credentials confidential
Notify us promptly of any unauthorized use
You are responsible for all activity conducted through your account.
INTELLECTUAL PROPERTY

PAYMENTS & FEES
Certain services offered by Blue Cove may require payment and may be subject to separate agreements.
Unless otherwise stated:
Fees and commissions are disclosed prior to engagement
Payments are non-refundable unless explicitly agreed
Third-party payment processors may be used
Blue Cove is not responsible for delays, failures, or disputes arising from third-party payment providers or from late or non-payment by brands unless expressly agreed in writing.
BRAND–CREATOR RELATIONSHIPS
Blue Cove may introduce or facilitate collaborations between brands and creators but is not a party to agreements entered into between them unless explicitly stated.
Creators and brands are solely responsible for:
Negotiating and fulfilling contractual obligations
Content creation, delivery, and performance
Compliance with advertising laws, platform rules, and disclosure requirements (including FTC or equivalent regulations)
Blue Cove does not guarantee campaign outcomes, payment, audience response, or platform performance and is not liable for disputes, breaches, or damages arising from brand–creator relationships.
DISCLAIMER
All Site content and services are provided “as is” and “as available.”
Blue Cove makes no warranties regarding:
Accuracy or completeness of content
Availability of creators, brands, or campaigns
Business results, earnings, or performance outcomes
Use of the Site and services is at your own risk.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Blue Cove shall not be liable for:
Indirect, incidental, or consequential damages
Loss of revenue, data, or business opportunities
Errors, interruptions, downtime, or security breaches beyond reasonable control
Actions or omissions of creators, brands, or third parties
Total liability shall not exceed fees paid to Blue Cove in the twelve (12) months preceding any claim.
INDEMNIFICATION
You agree to indemnify and hold harmless Blue Cove, its officers, employees, and partners from any claims, damages, losses, or expenses arising from:
Your User Content
Your breach of these Terms
Your violation of laws, platform rules, or third-party rights
THIRD-PARTY LINKS
The Site may include links to third-party websites for convenience only. Blue Cove is not responsible for:
External content or services
Privacy practices of third parties
Loss or damage resulting from third-party interactions
Access third-party sites at your own discretion.
TERMINATION
We may suspend or terminate access to the Site immediately and without notice if you:
Violate these Terms
Misuse the Site or services
Engage in fraudulent, abusive, or harmful conduct
Termination does not affect accrued rights or obligations.
GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the courts located within that jurisdiction.
